Indiana Child Finds Relief from Seizures with Cannabidiol (CBD)

Indiana allows the use of CBD oil for some conditions, but for one family, their daughter’s form of epilepsy was not included. The Jerger’s daughter suffered about 30 seizures a day. Pharmaceuticals weren’t working, but CBD oil significantly reduced her seizures.

The young child is just two years old and her family felt helpless in finding a treatment that worked, NBC News reports. Within one week of starting the CBD oil, the seizures were almost gone completely. Once informing their daughter’s doctors, they reported the parents to Child Protective Services. A treatment that was working for their daughter was putting the Jergers in danger of having her taken away.

Mr. Jerger, said, “Every time she has a seizure, to me, it’s like watching part of her life slip away.”

Once attention was brought to the story, Indiana’s Attorney General confirmed that their particular use of CBD oil remained illegal. The AG wrote an opinion piece stating, “As a matter of legal interpretation, products or substances containing cannabidiol remain unlawful in Indiana as well as under federal law.”

The family was ordering the CBD oil from a Colorado company. The THC in the CBD oil is minimal and is not enough to induce a high in anyone as it is derived from hemp and not marijuana.

Joel Stanely, one of the producers of the CBD oil, said, “The way my little brother puts it, you could smoke a joint the size of a telephone pole and not get high.”

Stanley acknowledged that CBD is not FDA regulated and would take years to get appropriate government approval.

He aid, “But more importantly, it would take nine, 10, 12, who knows how many years to get that product through the drug approval process.”

Dr. Staci Gruber has studied marijuana for 20 years and notes that research is lacking regarding CBD due to its Schedule I status.

Regarding the potential of CBD, Dr. Gruber said, “I don’t know that I have the terms to describe how much opportunity there is with regard to exploring CBD. I think there is limitless potential in a lot of different areas.”

The National Institute on Drug Abuse (NIDA) has even acknowledged the medical potential of CBD.

Once the family spoke with NBC News, the State of Indiana decided to leave the family alone and not take their daughter away. The state legislature then changed the state’s law to include her form of epilepsy within the confines of what ailments are approved for CBD oil use.

The family fought very hard to protect their daughter, and the treatment that works for her. They have no regrets. Her father said fighting for his daughter’s right to use CBD oil took more of a toll on him than his time serving the military in Iraq.

Mother, Lelah Jerger said, “It’s the hardest thing I’ve ever had to do. But I don’t regret it for a second because we’re all Jaelah has. We feel like we’re fighting for our lives.”
